Terms of Service
1. Acceptance
These Terms of Service ("Terms") govern your access to the Smitvi AI mobile application and website. If you do not agree, do not use the service.
2. Eligibility
You must be at least 18 years old and legally able to use cryptocurrency services in your jurisdiction. You are responsible for compliance with local laws regarding digital assets.
3. Service description
Smitvi AI provides:
- Portfolio analytics and health scores from read-only Binance data
- Risk monitoring, alerts, and educational briefings
- Yield and market information for informational purposes
We are not a broker, exchange, custodian, investment adviser, or financial institution. We do not hold, transfer, or control your cryptocurrency.
4. No trading or custody
The app does not execute trades, swaps, withdrawals, or deposits. All trading decisions are made solely by you on Binance or other platforms. We do not guarantee accuracy, timeliness, or completeness of data displayed.
5. API keys and account security
You agree to:
- Use read-only Binance API permissions only
- Keep your API keys, passwords, and devices secure
- Revoke access immediately if you suspect unauthorized use
- Provide accurate registration information
You are solely responsible for activity on your Binance account. See our Privacy Policy for how we handle credentials.
6. Educational use only
Content in the app (scores, alerts, briefings, APY examples) is for education and information. It is not a recommendation to buy, sell, or hold any asset. Cryptocurrency is highly volatile; you may lose some or all of your capital.
7. Demo and illustrative data
Demo mode and marketing materials may use sample or illustrative figures. Live data in the app depends on Binance API availability and your connected account.
8. Acceptable use
You may not:
- Use the service for illegal activity or market manipulation
- Attempt to breach, scrape, or overload our systems
- Reverse engineer the app except where permitted by law
- Resell or redistribute the service without permission
9. Intellectual property
The app, branding, and content are owned by Smitvi AI or licensors. You receive a limited, non-exclusive license to use the app for personal, non-commercial purposes.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMITVI AI AND ITS AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR DIGITAL ASSETS, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS (OR USD $50 IF GREATER).
12. Indemnification
You agree to indemnify Smitvi AI against claims arising from your misuse of the service or violation of these Terms.
13. Termination
You may stop using the app at any time. We may suspend or terminate access for violation of these Terms or to protect the service. Provisions that by nature should survive will survive termination.
14. Changes
We may modify these Terms. Material changes will be posted on this page. Continued use after changes constitutes acceptance.
15. Governing law
These Terms are governed by applicable law in the jurisdiction of our principal place of business, without regard to conflict-of-law rules. Disputes shall be resolved in competent courts of that jurisdiction unless otherwise required by mandatory consumer protection laws.
